Terms of Use

1. Acceptance of Terms

By accessing or using Payswitch via our mobile app or any associated services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use our platform.

2. Description of Service

Payswitch is a Software-as-a-Service (SaaS) platform that provides business management tools and enables businesses to accept online payments from their customers. Our service is designed to help legitimate businesses streamline operations and payment acceptance.

3. Account Responsibility & Eligibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update it as needed. To use Payswitch, you must be at least 18 years old and capable of forming a binding contract.

4. Fees & Payment Processing

Fees for using Payswitch are clearly disclosed at checkout, within your dashboard, or via separate written notice. All payment processing is handled through trusted third‑party processors. We reserve the right to modify fees with reasonable advance notice, but any changes will not affect existing subscription periods.

5. Prohibited Conduct

You agree not to misuse Payswitch. Prohibited activities include:

  • Using the service for any illegal, fraudulent, or unauthorized purpose.
  • Attempting to interfere with the platform’s security, integrity, or availability.
  • Processing payments for activities that violate applicable laws (e.g., illegal gambling, restricted substances, or unlicensed financial services).
  • Reverse engineering or extracting the source code of our software.

6. Termination & Suspension

We may suspend or terminate your access to Payswitch at any time, with or without cause, effective immediately, especially if you violate these Terms or create legal risk for us. Upon termination, your right to use the service ceases, but any outstanding payment obligations survive.

7. Data & Privacy

Your use of Payswitch is also governed by our Privacy Policy. By using our service, you consent to the collection and use of information as described therein. We do not store sensitive banking credentials in an unencrypted manner; any such data handling is limited to compliance requirements and detailed in our Privacy Policy.

8. Intellectual Property

All content, trademarks, logos, and software related to Payswitch are our property or that of our licensors. You may not copy, modify, or distribute any part of the service without prior written consent.

9. Disclaimer of Warranties

Payswitch is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non‑infringement. We do not warrant that the service will be uninterrupted, error‑free, or completely secure.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall Payswitch, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the service; (ii) any conduct or content of any third party; or (iii) unauthorized access, use or alteration of your transmissions or content. Our total aggregate liability for any claims arising from these Terms shall not exceed the greater of $100 or the fees you paid to us in the prior 6 months.

11. Indemnification

You agree to defend, indemnify, and hold harmless Payswitch and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms or your misuse of the service.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the service shall be resolved through binding arbitration in Sheridan County, Wyoming, in accordance with the rules of the American Arbitration Association. Each party waives any right to a jury trial or to participate in a class action.

13. Changes to These Terms

We may revise these Terms from time to time. The most current version will be posted at payswitch.africa/terms/ with the “Last Updated” date. By continuing to use the service after changes become effective, you agree to the revised Terms.
